Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Mohmmed Aqeeb Pathan(“LovedBy”, “we”, “us”, or “our”), the operator of the LovedBy service at lovedby.app(the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1.Agreement to These Terms
By creating an account, accessing, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated here by reference. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.
2.Who Can Use LovedBy
You must be at least 18 years old (or the age of digital consent in your country, whichever is higher) to use the Service. The Service is not directed to children, and we do not knowingly collect personal information from them. By using the Service you represent that you meet this requirement.
3.What LovedBy Is (Beta Notice)
LovedBy lets you (an “Owner”) create projects, collect text testimonials from your own customers via a public link or a one-time request link, moderate them, and publish approved testimonials through an embeddable widget and a hosted public “wall” page.
The Service is currently in beta. It may change, contain errors, be interrupted, or lose data. It is provided without any service-level commitment or uptime guarantee. We may add, change, or remove features at any time.
4.Accounts & Sign-In
Sign-in is passwordless — you authenticate using Google or an email “magic link.” You are responsible for maintaining control of the email account and any device used to access the Service, and for all activity under your account. Notify us promptly at support@lovedby.app if you suspect unauthorized access.
5.Plans, Fees & Usage Limits
- The Service is currently offered free of charge during beta.
- We may introduce paid plans in the future and may set, change, or remove usage limits (such as the number of projects, testimonials, or request links per account) at any time.
- If we introduce paid plans, we will describe pricing and billing terms at the point of purchase, and continued use of a paid plan constitutes acceptance of those terms. Payments, if any, will be processed by a third-party payment provider; we never store full card details.
- We may apply reasonable transition arrangements for existing users when limits or plans change, but we are not obligated to do so.
6.Acceptable Use
You agree not to use the Service to:
- Post or collect content that is illegal, infringing, defamatory, deceptive, hateful, harassing, or that violates anyone's privacy or rights;
- Publish fake, fabricated, or materially misleading testimonials, or incentivized testimonials without legally required disclosure;
- Send spam, or collect testimonials from people without their consent;
- Reverse engineer, scrape, overload, probe, or abuse the Service, the embed widget, or our APIs, or exceed applicable rate or usage limits;
- Circumvent security or access controls, or access data that is not yours;
- Use the Service to build a competing product, or resell it without our written permission.
We may investigate and take any action we consider appropriate for a violation, including removing content and suspending or terminating accounts.
7.Your Content & Testimonials
“Owner Content” means the projects, logos, settings, and testimonials you create, collect, or upload. You retain your rights in Owner Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, cache, reproduce, and display Owner Content solely to operate, secure, and improve the Service (including serving approved testimonials publicly and through third-party CDNs).
You represent and warrant that:
- You have all rights and permissions necessary to collect, upload, and publish the Owner Content, including each testimonial and any image;
- You have obtained any consent legally required from the people who submit testimonials, including consent to publicly display their name, role, company, photo, and words, and to any required privacy notices;
- The Owner Content does not infringe or violate the rights of any third party or any law.
8.Data Roles & Responsibilities
For personal data relating to your account (for example your name and email), we act as the data controller, as described in our Privacy Policy.
For personal data contained in testimonials you collect from your customers, you are the controller and we act as a processor and host on your behalf. You are responsible for the lawfulness of that collection and display, for providing required notices to testimonial givers, and for responding to their privacy requests. We will provide reasonable assistance where we are able.
9.Public Display & Search Indexing
The purpose of the Service is to publish testimonials publicly. Approved testimonials — including author name, role, company, avatar, message, and rating — may be displayed on your website and on a public wall page, served through public CDN URLs, and indexed by search engines (including via structured data). You and the people who submit testimonials should not include information they do not want to be public.
10.Intellectual Property
The Service itself — including the software, widget, design, and LovedBy name and marks — is owned by us or our licensors and is protected by intellectual-property laws. Except for the rights expressly granted to you to use the Service, we reserve all rights. You may not copy, modify, distribute, or create derivative works of the Service except as permitted by these Terms.
11.Content Complaints & Takedowns
If you believe content on the Service infringes your rights or is otherwise unlawful, email support@lovedby.app with enough detail to identify the content, your contact information, and the basis for your complaint. We will review valid notices and may remove or disable access to the content at our discretion. We may also forward complaints to the relevant Owner.
12.Third-Party Services
The Service relies on third-party providers (for example hosting, database, storage/CDN, authentication, email, error monitoring, and — in the future — payments). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions. The current list is described in our Privacy Policy.
13.Service Availability, Changes & Discontinuation
We may modify, suspend, limit, or discontinue the Service (in whole or in part), and may remove or delete content or data, at any time, with or without notice, and without liability to you. This includes the possibility that we stop operating the Service entirely.
Where commercially practicable, we will try to give reasonable advance notice of a full shutdown and a window to export your data. However, our failure or inability to provide such notice or export does not create any liability, and you are responsible for keeping your own copies of any content you need.
14.Suspension & Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends, and we may delete your content and data subject to our Privacy Policy. Sections that by their nature should survive termination will survive.
15.Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM DATA LOSS. YOU USE THE SERVICE AT YOUR OWN RISK.
16.Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL LOVEDBY OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
17.Indemnification
You will defend, indemnify, and hold harmless LovedBy and its operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) the testimonials and other content you collect, upload, or publish; (b) your failure to obtain required consents from, or provide required notices to, testimonial givers; (c) your obligations as a data controller; (d) your violation of these Terms or any law; or (e) your misuse of the Service.
18.Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
19.Governing Law & Disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved exclusively in the courts located in Mumbai, Maharashtra, India, and you consent to their jurisdiction, except where applicable law gives you the right to bring proceedings in your local courts.
20.General
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
